Off plan buyers in Spain, do you know your rights? The use of “for illustration purposes only” (or similar disclaimers) does not hold legally when it conflicts with mandatory consumer protection rules.

Spanish courts treat advertising content—brochures, renders, specifications, sales emails, screenshots and other pre-contractual materials—as binding and enforceable, even if it’s not reproduced verbatim in the final contract.

So, if Survey Spain’s ‘snagging’/buyer’s inspection shows differences from the marketing, if it’s important to you the Buyer, it may be of benefit to contest the situation and either walk away with all money refunded or receive discounts or ‘extras’ as compensation.

Remember though, there is rarely compensation for the hassle, stress and tears, so do your homework, or get Survey Spain’s surveyors/inspectors to check the details of the development and practicality of promotors and agent’s promises before you buy.
